US to look into ‘violation’ of extradition treaty

After submissions by various social organisations and management of gurdwaras, the US Department of Justice has urged the State Department to inquire into alleged violation of the extradition treaty between India and the US in the case of Daya Singh Lahoria.

Lahoria, who was wanted in certain cases in India, was arrested in Minneapolis, US, on August 3, 1995. On the request of the Government of India, he was extradited to India on the basis of an order passed in this regard by the District Court of Fort Worth, Texas.

He was handed over to the Government of India in connection with two cases on January 17, 1997. As per the order related to his extradition passed by Justice McBryde, he was to be tried only in these two cases. However, it is alleged that he is being tried in eight more cases in violation of the rules of the extradition treaty.

Lahoria was convicted for life in one case by a Jaipur court. He was acquitted in another case. In Rajasthan, life term can’t exceed 14 years. However, Lahoria has been in jail for the past 18 years. The state of Rajasthan has declined repeated appeals regarding his release by his lawyers.
