Concerned about the fate of numerous young Indian women who are often swept away by fascinating marriage promises by Non-Resident Indian grooms, a city court on Friday held that abandoning such women after the wedding or ill-treating and abusing them will trigger criminal prosecution against such men and they can be punished for perpetrating cruelty.
Ordering community service as punishment for a 43-year-old NRI, Additional Sessions Judge Kamini Lau noted that while a court faced a legal handicap in charging the accused husbands under other provisions of the IPC, they can certainly be hauled up for committing cruelty to the women.
In this case, the accused got a community service punishment, to teach at a city blind school for six months, as he had already served almost one year behind bars under Section 498 (I), that entails for a maximum two year jail term for subjecting wife to cruelty. The court also considered that he had a child from his earlier marriage to take care of.
