EC OVERSTEPPED JURISDICTION, SAYS PHOOLKA

LUDHIANA: Amid the row over transfer of IG Kunwar Vijay Pratap Singh from the special investigation team (SIT) probing the police firing incidents at Behbal Kalan and Kotkapura, senior advocate and Dakha MLA HS Phoolka on Wednesday wrote to the CM terming the order passed by the election commission (EC) illegal and overstepping its jurisdiction.
Terming it unfortunate, Phoolka also stated it is the failure of the state government that it has not pursued the matter adequately.
The Punjab government has asked the EC to review its orders but the government should also ask the EC as to how the transfer of the IG would hamper the investigation, said Phooka.
He added that the investigation has reached a crucial stage and is likely to conclude soon. At this stage, the IG’s transfer would hamper the probe, he said.
Kunwar Vijay has no direct role in the conduct of elections. The EC could have barred him from disclosing any part of the investigation which could influence the election.
The EC has no power to ask for the transfer of an officer who is not connected with the election process in any way, said Phoolka.
