EC seeks dismissal of petition against Anil Joshi

The Election Commission has urged the Punjab and Haryana High Court to dismiss the petition challenging the election of Punjab Local Bodies Minister and Bharatiya Janata Party legislator from Amritsar North, Anil Joshi.
In an affidavit filed by Punjab Additional Chief Electoral Officer Raminder Singh before the high court, submitted that all allegations had been levelled against the BJP legislator in the election petition, were false and wrong.
In the affidavit, the EC has submitted that Joshi at the time of his election as MLA, was a voter from Amritsar North only. Besides, the petitioner had not filed the petition within the prescribed period of 45 days after the result declared, the official further submitted.
The election result was declared on March 6, 2012 and according to norms petition challenging the election could be filed by April 20, 2012 while the petitioner’s first complaint to Election Commission in this regard was made on November 19, more than six months after the expiry of the stipulated time period for filling the election petition.
The Division Bench of the high court comprising by Justice A K Mittal and Justice Sneh Prasar has adjourned the matter till January 19.
