MLA Simrajit Singh Bains coming out after a medical examination at the civil hospital in Ludhiana on Thursday.
At that time Bains was present at his office and was listening to the grievances of residents. When his sister-in-law opened the door the police insisted for the search of the house.
Meanwhile, Bains came out from the office. He sarcastically said to the police that if they have called him up, he would come himself to the police station for his arrest, why they need to send 100 cops for his arrest.
Bains was also brought to the civil hospital under tight security for a medical checkup. The police did not allow anyone to meet Bains at the hospital.
Bains was booked at division number 7 police station under sections 332 (voluntarily causing hurt to public servants), 149 (unlawful assembly), 186 (obstructing public servant from discharge of public functions) and 188 (disobedience to orders promulgated by public servant) section 153 (Wantonly giving provocation with intent to cause riot) of the IPC on Wednesday, when the police have tried to stop him on the Chandigarh road. Bains along with his supporters was going to Chandigarh to hold protest outside chief minister Parkash Singh Badal’s house on Wednesday.
Complainant in the case assistant commissioner of police (ACP) Ashok Puri has alleged that Bains was provoking the public against the state government and when the police party tried to inform the MLA regarding the imposition of section 144 of the CrPC under which more than five people cannot gather at one place, the accused MLA misbehaved with the cops and escaped from the spot.
Elder brother of Bains, Balwinder Singh Bains, who is the MLA from Ludhiana South constituency was arrested on Wednesday along with his 23 supporters, including independent councillors under sections 107/151 (apprehension of breach of peace and tranquility of the area) of the CrPC.
MLA Balwinder Bains was produced in the court of additional deputy commissioner of police (ADCP headquarters) Sukhpal Singh Brar from where they were sent to jail till November 2.
It is pertinent to mention that the MLA brothers along with the members of team Insaaf were on the way to gherao the residence of Punjab chief minister Parkash Singh Badal to register their protest against the recent sacrilege incidents and deteriorating law and order situation in Punjab. As the MLA brothers along with their hundreds of supporters reached on the Chandigarh road the police tried to stop them but Simarjit Singh Bains escaped from the spot.
However, MLA Simarjit Bains along with his supporters reached Chandigarh to register his protest but he was reportedly injured in latchi-charge by police there.
Simarjit Singh Bains was arrested by the Chandigarh police under section 107/151 of the CrPC on Wednesday, but he was released later.
Reacting on the police action, Paramjit Singh Bains, brother of MLA Bains said his brother is an MLA and he was not trying to flee, but the police were acting as they have come to arrest a hardcore criminal.
He also added that his brothers have planned to hold peaceful protest in the desecration of Guru Granth Sahib, but the police following the orders of deputy chief minister Sukhbir Singh Badal have arrested his brothers.
He said the Punjab government and police have seized the constitutional rights of individuals of registering his protest.
