HC notice to Harsimrat on review plea

CHANDIGARH: The Punjab and Haryana high court on Wednesday sought a response from Union minister for foodprocessing Harsimrat Kaur Badal on a review petition challenging the dismissal of an election petition against her.

The petition challenging her election from Bathinda parliamentary constituency in 2014 was dismissed by the bench of justice Mahesh Grover on May 8, 2015, terming it “time-barred”. However, in August, petitioner Navjot Singh had filed a review petition, submitting that his argument that the plea was not “time barred” had escaped the notice of the high court. The election results were out on May 16, 2014, and the 45-day limit was to be over on June 30, without counting the result day.

“In Tarun Prasad Chatterjee versus Dinanath Sharma case of 2001, the Supreme Court had dealt with the issue of computation period of limitation to file election petitions under Section 81 (1) of the Representation of People Act, 1951, and had held that the first day (the day of declaration of result) was to be excluded and the last day included,” petitioner’s counsel SS Swaich submitted. Muktsar NSUI leader Navjot Singh had sought Bathinda MP’s disqualification on the grounds that in her campaign advertisements on TV, she had sought votes in the name of religion.
